Article 1 – General provisions

Access to the www.mariehelenedetaillac.com website (hereinafter the "Website") and the use of its content is subject to the conditions of use set out below.
The Website is comprised of the institutional site of Marie-Hélène de Taillac and the E-shop of Marie-Hélène de Taillac products (hereinafter the "E-shop").

The E-shop www.mariehelenedetaillac.com (hereinafter the « E-shop) belongs to the company ILU S.A.R.L with a capital of 15 000 euros, registered in the Paris Register of Trade and Business Names as number B 453 307 621, VAT number FR 444 533 076 21. The head office is located 8, rue de Tournon 75006 Paris

Access to sales via the E-shop is exclusively reserved for Clients, as defined below residing in Austria, Belgium, Denmark, Finland, France, Germany, Ireland, Italy, Luxembourg, Portugal, Spain, Sweden, The Netherlands, the United Kingdom.

A Client is regarded as any consumer who is a natural person and who is acquiring the Items for his own exclusively personal use.

The T&C govern any relations between the client (hereinafter the « Client » or « Clients » or « You ») and www.mariehelenedetaillac.com (hereinafter the « Parties ») as these relate to the purchase of Marie Hélène de Taillac Items (hereinafter the « Items ») being sold either through the intermediation of Customer Consultants via the E-shop. The language used to conclude the contract is English.

So far as sales via the E-shop are concerned, every time the Client places an order via the E-shop, he will be asked to confirm that he accepts the terms of the T&C in force on the date the order is placed.

In the event that the public is still able to access these T&C via other Internet sites or by any other means after the date on which they were removed from the Website, theses T&C will no longer be used as evidence against Marie - Hélène de Taillac.

The system thus introduced, which supposes the Client’s active participation, complies in all respects with the requirements relating to distance selling, particularly Articles L.111-1, L.113.3 and L.121-18 and following of the Consumer Code.

The utilization of the Website and / or any purchase made from the E-shop is / are expressly and exclusively regulated by (I) the T&C, (II) Our Data Protection Policy and (III) Our confidentiality policy and (IV) any other terms and conditions published or otherwise referred to from time to time on the Website (hereinafter the « Contract »)

Article 3 – Content of the Offer and Availability

The Items available for sale on the Website (in accordance with the terms defined in article 4 below) are on display in « E-shop » chapter. ILU S.A.R.L reserves the right to change the Items offered on the E-shop at any time and without prior notice.

The Items and prices we offer are valid while they appear on the E-shop and within the limits of stock availability.

You will be informed about the availability of the Items in the product description of the Item. Errors or modifications may exceptionally occur, particularly if several Clients place orders for a particular Item simultaneously. If the Item is unavailable after your order has been placed, we will let you know by e-mail as soon as we can and will offer You the chance either to order a replacement Item from the ones shown on the Website or to cancel your order. If your bank account has been debited, you will be refunded within 30 days maximum.

ILU S.A.R.L cannot be held responsible if Items ordered are out of stock of otherwise unavailable.

Article 4 – Price and Payment

4.1 – Price

The price of the Items is shown on the Website in euros (€) and is deemed to include VAT but no delivery charges.

The final cost of your order will include the delivery charges.

ILU S.A.R.L reserves the right to change the price of products offered on the E-shop at any time and without prior notice. Items are invoiced at the tariffs shown on the E-shop on the date your order is confirmed, subject to the availability of the Items ordered at that precise time.

ILU S.A.R.L checks to ensure that all prices shown on the E-shop are accurate. If cannot, however, give any guarantee that no errors have occurred. Should an error in the price of an article occur, ILU S.A.R.L will give the Client the option of reconfirming the purchase of the Item at the correct price or of cancelling the order. If ILU S.A.R.L is unable to contact the Client, the order will be considered cancelled.

4.2 Methods of Payment

a) The Client can pay the cost of his order if the total amount is under € 10, 000

- with the following credit cards : Carte Bleue, Visa, Mastercard, American Express

All orders will be dealt with as soon as they have been validated.

All the payments made on our E-shop are secured thanks to the process of encoding SSL.

The transaction will only be debited against the Client’s credit card when the card details have been verified, the company that issued the credit card used by the Client has authorized the debit. ILU S.A.R.L has confirmed that the Item is available, and the order is ready for shipment.

b) When the total amount of the order is above € 10, 000, the Client will be invited to pay the cost of his order by banking transfer.

c) If certain articles have been ordered are not available, only the price of those Items that are available and that have been shipped, will be debited.

4.3 Transfer of Ownership

Ownership transfer of the good purchased online is confirmed once full payment is validated. Transfer of risk and loss or damage of the purchased good is carried out from the delivery of the Item.

Article 5 – Ordering goods

5.1 – Orders placed via the Website

Once the ordering process has been completed, and after accepting the T&C, the Client must confirm the order by clicking on the « confirm » button. If the Client already has a customer account, he will then be asked to pay for his order. If he does not, he will be asked to set up a customer account before paying for his order.

If the client needs to correct any errors made when filling in the data, he will need to follow the appropriate amendment procedure shown on the E-shop before submitting his order. Clients Service will send the Client an e-mail confirming receipt of his order and a summary of what it comprises.

5.2 – Confirmation of Order

The Client should check the contents of the order confirmation as soon as possible and let ILU S.A.R.L know immediately if there are any errors or omissions.

ILU S.A.R.L may ask the Client to provide additional information by filling a form. This document must be sent by email with a photocopy of the customer ‘s ID and a copy of the type of payment used for the order.

Data entered via the Website constitutes evidence of all transactions entered into between ILU S.A.R.L and the Client. If a dispute arises between ILU S.AR.L and one of its Clients regarding a E-shop transaction, the data entered by ILU S.A.R.L shall be regarded as absolute proof of the contents of the transaction.

Invoices for all purchases made can be viewed by logging into « My Account », which can be accessed from the Website.

In accordance with the provisions of article L.134-2 of the Consumer Code, when an order is placed for a sum equal to or more than 120 euros, ILU S.A.R.L shall retain an electronic copy of the written docket recording the contract entered into between ILU S.A.R.L and a Client for a period of 10 consecutive years from the date the contract was conclude or the date the goods were delivered. After proving your identity, you are then entitled to access this document at any time following a single request to Customer contact center: paris@mhdt.net

Article 6. Delivery

For reasons of security, Items purchased on the E-shop will be delivered in plain packaging to the address linked to the credit card, and the signature of an adult aged 18 years above will be required upon delivery.

6.1 Delivery Zones

Items purchased on the E-shop can only be delivered within the countries referred to in Article 1 above. Any address that is outside of these countries will be refused when the order is being processed. For security reasons, no order for which a Cedex or a post office box number is supplied will be able to be processed.

6.2 Means of delivery, delivery charges and transport costs.

DHL Express or La Poste by Valeur Déclarée will deliver all purchases. Orders are shipped Monday to Friday, except on public and national holidays.

The merchandise must be delivered in the presence of a person who is legally of age, the delivery person handing the recipient the parcel receipt and asking him to sign it. Three (3) attempts will be made to deliver the goods per shipment.

Should the parcel be refused, or after (three) attempts to deliver it, the parcel will be returned to ILU S.A.R.L.

If there is no-one available to take receipt of the parcel, an advice note saying that an attempt had been made to deliver it will be left in the recipient’s letter box. The Client can then contact DHL Express to reschedule delivery or go in a Poste Office.

When the goods are delivered, You should check that the Articles are in order and indicate any reserves you may have in writing, on the delivery note if possible. Please then sign it and note any anomalies observed (parcel opened, damaged, Item damaged, missing etc ). You should then contact the Customer consultants by email. paris@mhdt.net

If the articles do not comply with your order or if they are not to your satisfaction, You may return them and ask for an exchange or for a refund within the conditions provided for in Article 6 below.

6.3 Delivery Times

Delivery times depend on the Items ordered and on the country in which the order was placed and You will be advised of the delivery time when you place the order.

The delay of the delivery is less than15 days.

ILU S.A.R.L cannot be responsible for unforeseeable delays in delivery.

If 7 days or more exceeds the delivery date for the Item, the Client will be entitled to terminate the contract by informing ILU S.A.R.L in a letter sent by Recorded Delivery.

If ILU S.A.R.L is unable to deliver Items that have been ordered because these have become suddenly unavailable, even temporarily, it will immediately advise the Client of this and in any case within 30 (thirty) days at the latest by electronic mail.

Any monies already paid by the Client will be reimbursed as soon as possible and in any case within 30 days of payment of monies paid.

Article 7 – Right to a cooling-off period – Returns – Exchange - Reimbursement

a) Condition

ILU S.A.R.L is anxious to ensure the Client’s total satisfaction.

The Client have the benefit of a cooling - off period which he will be able to exercise for 7 days following reception of the Item ordered.

b) Procedure

Products that have been purchased on the Website or through the Customer Services may be returned to the following address: ILU S.AR.L, 8,rue de Tournon 75006 Paris.

To make the return process easier for you, please follow the steps mentioned below.

First, please call the Customer Contact Centre (+33.1. 44.27.07.08) to obtain a Return Number (RN) (the communication costs will not be surcharged by us).

Thereafter:
I) Fill out the required information, with the Return Number (RN) if applicable, on the return form provided in the original box or packaging and sign it,

II) Include the completed return form with the product, all its accessories, the Product Manual, the Certificate of Authenticity, as applicable, and all other documents, in its original box and delivery package,

III) Seal the delivery package and affix delivery label to it,

IV) Call DHL Express to arrange pick-up or go in a Poste Office and send it by Valeur Declarée.

The Customer or Gift Recipient, as the case may be, must keep a proof of return shipment, and ILU S.A.R.L accepts no liability in the event that such proof cannot be produced. Only merchandise received by ILU S.A.R.L will be eligible for a refund or exchange, as applicable.

Upon receiving a return, ILU S.A.R.L will verify that the returned product complies with these Conditions of Sale.

Refunds will be made using the same methods of payment used to purchase the Item.

If the Client wishes to have a refund, the total value of the returned Item will be refunded by crediting the Client’s bank account. The Cost of returning the Item will be the Client’s responsibility.

If the Client wishes to exchange the Article, ILU S.A.R.L will cover the return costs for shipping the goods sent in exchange of the initial order. If goods are exchanged for a second time, the cost of returning the goods and re-shipment will be payable by the Client.

ILU S.A.R.L will send notification by e-mail once the refund has been made.

c) Conditions for returning a product

ILU S.A.R.L products must be returned in a new and unused state. Personalized ILU S.A.R.L products cannot be returned to ILU S.A.R.L for exchange or refund.

Please also return the original Marie-Hélène de Taillac box and delivery package, with all its accessories, the Product Manual, the Certificate of Authenticity, as applicable, and all other documents, with all protective materials in place and tags and stickers attached to the products. Failure to do so will respectively entitle ILU S.A.R.L to withhold the corresponding value from the refund made to the Customer, or to refuse the products returned by the Gift Recipient.

All returns will be subject to strict Quality Control (QC) by ILU S.AR.L to ensure that the returned products satisfy these requirements.

If the returned product satisfies Quality Control (QC), ILU S.A.R.L will proceed with the refund or exchange, as applicable.

d) Customers’ and Gift Recipients’ exchanges

Customers and Gift Recipients may exchange a product purchased on E-shop or through the Customer Services for another Marie-Hélène de Taillac product if the product to be exchanged complies with these Conditions of Sale.

Should a product be returned for exchange to ILU S.A.R.L E-shop by a Customer or Gift Recipient, only the Customer will be entitled to receive a refund of the price difference when the product to be returned is more expensive than the desired Marie-Hélène de Taillac product. If the returned product is less expensive than the desired product, the Customer or Gift Recipient, as applicable, will be charged the difference in price.

In both cases, ILU S.A.R.L will send an e-mail to the Customer which specifies the value of the returned product, the price of the item for which the original product has been exchanged and the difference to be paid by Customer or the amount that the Customer is entitled to receive.

Article 8- Legal Guarantees

Items sold on the Website are subject to the legal guarantee conditions provided for in articles L.211-4, L.211-5 et L.211 – 12 of the Consumer Code, as well as articles 1641 and 1648 of the Civil Code.

In your capacity as consumer, you may have legal rights under applicable national legislation governing the sale of consumer goods; these Conditions of Sale do not affect those legal rights.

Article 9 – Errors, Inaccuracies

ILU S.A.R.L constantly updates the information published on the Website. It is impossible, however, to guarantee that the Website is at all times error-free. The Website may contain data input errors, inaccuracies or omissions, some of which relate to the price and the availability of an Item and the description of the Item itself.

ILU S.A.R.L reserves the right to correct errors, inaccuracies or omissions, even after an order has been shipped, and equally reserves the right to change or update information at any time without prior notice.

Article 10 – Law applicable and competent Court

These Terms & Conditions are subject to French law. Should any problem arise when ordering or taking delivery of Marie-Hélène de Taillac items, before taking legal action the Client has the opportunity of seeking an amicable solution, particularly with the assistance of a consumer association or any other advice of his choosing.

Any dispute that may arise from the interpretation or execution of theses Terms & Conditions or from the consequences of same will be subject to the exclusive jurisdiction of the French courts.
